What is the process?

1. Complimentary 15-minute Intake Phone Call. Upon initiating the mediation process, AVIV Family Mediation Services offers an intake call that is free of charge. This initial consultation serves as a brief but crucial opportunity for the parties involved to gain a better understanding of the mediation process and to determine if mediation is the right path forward.

2.Informational Paperwork. If the parties express a willingness to move forward with mediation, the next step involves completing.The paperwork serves multiple purposes: it allows our mediator to become familiar with the particulars of the dispute, to gather information necessary for planning the mediation sessions, and to ensure that all pertinent details are thoroughly documented. This is also where the parties will sign the “agreement to mediate” which includes a payment agreement.


3. The First Mediation Session. The first session will be a time of gathering information and setting up a plan. The frequency of subsequent sessions will depend on the parties, the issues at hand and ultimately the ability to settle on an agreement.

4. Drafting The Agreement and Filing If Necessary. Upon reaching agreement, if specific situation requires it, your mediator can draft a “memorandum of agreement” and give it to the parties. At this point, if the parties want to involve a judgment /court order, the parties have a choice to file this with the court themselves or hire an attorney to file.
